Q: We have a hawks nest nearby our garden and realized that it was the hawks that were stealing our tomatoes in addition to the deer!  The tree is about 40’ tall .

A: Since hawks eat live animals almost exclusively, I doubt you have a vegetarian hawk in your backyard. It’s much more likely that a squirrel stole the tomato and took it up the tree to enjoy.

Perhaps the furry burglar was grabbed by the hawk as it enjoyed its last meal!
